Daughter Seeks Justice For Father’s Tragic Death
The Idaho Supreme Court recently reversed a car accident claim ruling for a fatal car crash involving a Payette County deputy. The Idaho Supreme Court ruled on Friday in favor of a Canyon County woman who is suing the Idaho State Police for the investigation of an accident that killed her father.
Barry Johnson, the father of Jackie Raymond, who is pursuing the lawsuit against the Idaho State Police, lived near New Plymouth, Idaho. Mr. Johnson was tragically struck and killed eight years ago while attempting to pull into his driveway off Highway 30 on October 18, 2011.
Johnson’s red jeep was hit mid-turn by Deputy Scott Sloane of the Payette County Sheriff’s Office. Sloane was responding to a 911 call when he clipped the back of Johnson’s car going over 110 mph.
Jackie Raymond’s original claim of “tortious interference” by the Idaho State Police in the crash investigation was previously dismissed by a district court. Recently though, the Supreme Court reversed that ruling and now the case will go back to trial.
Raymond’s attorney, Nathan Olsen, told the Idaho Press, “We’re very pleased with the decision. It was a well-though-out analysis by the Idaho Supreme Court, and we look forward to pursuing Raymond’s claims finally.”
The deputy involved in the crash, Sloane, was initially charged with vehicular manslaughter. But the case was later dismissed on the count that there were too many discrepancies to prosecute the case.
Raymond then sued both the Idaho State Police Department and Payette County for tortious interference and wrongful death. While a judge dismissed the police department, Raymond was awarded $150,000 in 2018 from Payette County.
Raymond proceeded in asking the Idaho Supreme Court to bring back her claim that the Idaho State Police interfered with the investigation of her father’s fatal crash. Even though a district court judge claimed the tort and its facts were “too speculative to establish such a claim,” the Supreme Court ruled last Friday that the claim could be brought forth.
“At the end of this we hope to not only obtain justice for Ms. Raymond, but we hope this will lead to some reforms, so this kind of thing doesn’t happen again,” said Nathan Olsen, Raymond’s attorney.
